CONDITIONS GENERALES DE VENTE


1. Shipping costs and additional charges
 
Shipping costs charged to an order are paid to the carrier, the seller is not responsible for their cost and their possible reimbursement, in case of breakage or loss of the package, the buyer must contact the carrier directly. The seller undertakes to ship the order within 10 working days, but it is possible that an unforeseen event slows down the shipping time, also, if after 12 working days the package has not been shipped, the buyer can request the cancellation and reimbursement of his purchase.*
 
Please note that €0.50 will be added to the order total for packaging and order processing costs.

Please note - For buyers outside Europe: Customs fees are the buyer's responsibility.
 
*The seller is not responsible for possible additional delivery delays via carriers.
**In the event of loss or damage to the package, the seller is not responsible; the buyer must reimburse the carrier.


2. Warranty for used items
 
The items sold by "Le Gai Fouillis" are second-hand goods, it is therefore implied that these items are not new or in perfect condition, they may have defects and/or wear from use or time. The seller undertakes to list the defects and wear on the advertisement of the item sold. If a defect or wear has not been mentioned, the buyer is entitled to return his item and claim a refund. If a defect or wear was correctly reported on the advertisement, which could have been dissuasive for the buyer, but the latter only notices it upon receipt, it is the buyer's responsibility, an arrangement can be made with the seller, but the buyer should in principle keep the item.*

3. Right of withdrawal and ownership

You have a 14-day right of withdrawal from the date of receipt of your order. If the item is as described but you no longer want it, you must contact the seller to inform them and arrange a return.* *See returns and refund policy

An item becomes your property once it is shipped to you. Before shipment, it becomes the property of the seller, who may cancel the sale at their discretion. Once the 14-day cooling-off period has expired, payment will be collected by the seller.


4. Precious metals and jewelry guarantee (Expired)

Regarding jewelry, the seller guarantees the authenticity of the precious metal hallmarks and undertakes to detail as best as possible the quality of the jewelry sold, whether costume or not, to the best of his ability. Gold or silver plated jewelry being subject to different legislation from other goods, the return policy for this type of item is as follows: "The right of withdrawal in the context of the purchase/sale of precious metals is 48 hours from the signing of the contract, except for investment gold transactions. When one of the parties wishes to exercise this right, the professional returns his property to the seller in exchange for the amount he had received.


5. Prices, reservations, cancellation, payments, discounts

The prices of the items are assigned according to the current prices, for the type of good concerned, in the trade at the time of the sale, this price can be revised upwards by the seller during the entire duration of the sale according to the increase in value, new knowledge of the seller as to the value of the object, or downwards according to the periods of sales, end of stock discounts or promotions. The seller reserves the right to make commercial gestures, gifts, discounts.
 
Items and shipping costs must be paid in full by the buyer before shipping, no deferred payments and no off-platform payments.

6. Information on electrical risk:

Regarding electrical appliances

In accordance with Articles L 111-1 and L 221-1-1 of the French Consumer Code.
Equipment sold second-hand = inspection and connection to be carried out by a qualified professional.



GENERAL CONDITIONS OF RETURNS


1. Returns and Refunds

You have a 14-day right of withdrawal from the day following the date of receipt of your order (extended to the next working day if the deadline falls on a public holiday or weekend), in accordance with French law relating to online purchases. You may, before this deadline, return the item(s) you have purchased. Return shipping costs are your responsibility. The returned item(s) will be fully refunded within 14 days of receipt by the seller. Before the withdrawal period expires, you must send the seller one of the following documents: Standard withdrawal form. Other written document expressing your wish to withdraw.
 
This right does not apply to the following goods:

-Goods or services whose price depends on fluctuations in financial market rates, e.g., precious metals.
-Goods that deteriorate or perish quickly, except for food products with a minimum shelf life.
-Goods that you have opened and cannot be returned for hygiene or health reasons.
-Goods that cannot be separated from other items (e.g., television remote control).

Please note:
 
The shipping costs for a return package are the responsibility of the buyer.

The seller is not responsible for any potential shipping costs or additional fees and their reimbursement if they are not charged by him.
 
If one or more items arrive damaged despite the care taken with the package, the seller is not responsible; you must contact the carrier for a refund.

If it turns out that the package was poorly prepared and the item(s) are damaged for this reason, the seller agrees to refund the damaged item(s).
 
If you return an item(s) that you have damaged, you will be required to issue a refund for that item(s) to the seller.

The returned item must be the same as the item sold for the buyer to be eligible for a refund.
In the event of attempted fraud, the seller reserves the right to take legal action.
 
If an intact item(s) is/are damaged during return transport, despite correct packaging, the seller must be reimbursed by the carrier. However, if it turns out that the return package did not guarantee proper protection of the item(s), you must reimburse the seller yourself.
 
In the event of loss of the package, the buyer will be fully reimbursed by the seller. The seller will also be reimbursed by the carrier or platform.
